At 247 Football, we value your privacy as a user (referred to as User, you or your) and understand the importance of keeping your personal information secure. We have this Privacy Policy to help you understand how we collect, store, use and remove the personal information that we collect on the 247 Football platform including on the 247 Football website, the 247 Football mobile application (the Application), training program, competition or challenge, both online and offline, social media pages, online shop or one of our other products or services, all of which are part of 247 Football’s services (the Platform).

As a global company, our Privacy Policy has been developed in accordance with a range of legislation which applies to us (the Data Privacy Law). Please be sure to read this entire Privacy Policy before using or submitting information through the Platform. By using or submitting information through the Platform, you are acknowledging the collection, transfer, manipulation, processing, storage, disclosure and other uses of your personal data as described in this Privacy Policy. What Personal Information We Collect

We collect your personal information (either directly through your use of the Platform or when you communicate with us in any other way, or indirectly through our third party partners or providers) in a number of ways to provide you with our products, services and related information. Personal information includes any information or opinion relating to you which allows us to identify you, such as your name, screen name, phone number, social media name or ‘handle’, postal address, email address, date of birth, details of products or services you have purchased, payment details and information about your access to the Platform.

 Depending how you interact with us, we may (either directly or indirectly) collect the following categories of personal information:

 1.      first and last names, screen name, contact information such as email address, home address and telephone number, date of birth;

2.      other information such as country of residence, football club, team, playing age group, gender, football preferences such as favourite foot;

3.      fitness/lifestyle activity data provided by you on the Platform or generated through your use of the Application (e.g. training sessions completed, duration, number of juggles);

4.      information you provide about yourself and any preferences in your User Account;

5.      information about yourself which you choose to post or share on the Platform;

6.      details of other interactions that you have with us, together with any other information that you choose to provide us with, for example, through your interactions with our customer and technical support teams or via free text fields such as when completing session reviews, giving feedback to us about your experience in the Platform, completing member surveys, making notes about your training etc.;

7.      information about your purchases of products and services from us or our third party partners who may provide or promote their own products or services through the Platform;

8.      payment information, such as your transaction details, if you purchase something directly on the Platform or from our e-commerce providers.

9.      information about your use of the Platform;

10.   where you have selected particular services or features on the Platform (e.g. scheduling your Sessions, sharing your training activities with friends through social media platforms), your photos, audio, contacts and calendar information, as well as your social network information (including credentials and any information from your public posts about 247 Football or your communications with us);

11.   when you have sent a referral link to another person or been referred to 247 Football by another person, we may be able to identify the identity of the person who referred you or who you referred;

12.   any information you share in a social media post where you tag, use a hashtag, link, or otherwise direct the post to our attention;

13.   when you have elected to sign up and log into the Platform using a third-party account you created (e.g. through Facebook, Apple or Android), information you have agreed to make available to us (e.g. name, email address, profile information, preferences);

14.   your location where the IP address of your computer or device is used to determine your geographic location so that we can customise your experience on the Platform (e.g. language settings);

15.   internet or other similar network activity depending on your permissions. For example, browsing identifiers, advertising ID, cookie identifiers, information on your interaction with the website, or advertisement.

16.   we seek consent from the User at the time of purchasing and registering the product to use the information collected from them (including the minor). Subscriptions on behalf of a minor must be completed by the minor’s parent or legal guardian or with their consent. We are unable to provide access to the Platform to persons under 16 years of age or who are legally a minor in their relevant location, without the parent or guardian providing consent to administer the account subscription

 You can always withdraw your consent at any time by contacting us directly – see contact details below.

 

 How We Use Your Personal Information

 Your personal information may be used for the following purposes:

 1.      To provide features of the Platform and the products and services you request, including:

a.      to create, set up and log in to your User Account;

b.      to manage prospective purchases, purchased subscriptions and payments including to provide quotes and offers, including to communicate with you about the orders and to process information for our internal accounting, billing and audit purposes;

c.       to send a confirmation notice to the registering User; to administer and manage accounts, including password resetting, responding to questions raised by Users, to contact the User about any problems with the User’s account or conduct on the Platform;

d.      to collect and store details of your training activity so that you can review it on the Platform and track your progress. We may also use this information to calculate further information about your activity so that this can be provided to you as part of the functionality of the Platform;

e.      to display your Screen Name, ranking, Leaderboard position and training activity including by publishing this information on the Platform, social media, in the 247 Football newsletter, providing feedback to clubs and coaches, marketing materials, and to provide results data for each User or club, or for any other legal use at the full discretion of 247 Football. You can elect to remain anonymous on the Leaderboard at any time;

f.       to send prizes or certificates for participation and performance on the Platform;

g.      if you choose to post in the Community Forum, the information that you share will be public information that can be accessed by anyone whether or not they are a part of the 247 Football community. As the information posted to the Community Forum is public information, it will also be indexed and accessible via third party internet search engines, websites and apps; or

h.      to offer you personalised training recommendations based on your previous interactions with the Platform.

 

2.      To communicate information about our products and services and for other promotional purposes.    

 With your consent, or as otherwise permitted by applicable Data Privacy Law, we will use your personal information to provide information and recommendations that we believe is of interest to you, prior to, during, and after your interactions with us, including marketing communications and news concerning our products, services, events and other promotions. You can opt-out at any time after you have given your consent to such communications. In providing tailored promotional materials to you, 247 Football may use the personal information collected through your use of the Platform, such as the user preferences you set and profile data you submit, any training activity data generated through your use of the Platform that you have identified to us.

 

3.      Customer service communications

 We use your data to manage our relationship with you as our customer and to improve our services and enhance your experience with us (e.g. to respond to your inquiries when you contact us). At times, we may also conduct customer surveys to gauge satisfaction with our Platform and the services and products that we provide.

 

4.      Administrative or legal purposes

 We use your personal information to operate our business, including for statistical and marketing analysis, systems testing and to diagnose technical and service problems, maintenance and development of the Platform, or in order to deal with a dispute or claim. We may also perform data analysis based on the information we collect from you for statistical and marketing analysis purposes – for example, we may use information about how users of our Platform search for and find specific Sessions to better understand the best ways to organise and present the content that we offer.

 For the purpose of providing our services to you or operating our business, we may transfer your personal information to our service providers to enable them to perform their services we have engaged them to perform or to enable us to conduct our business. For example, our service providers may handle 247 Football’s credit card processing, shipping, data management, email distribution, market research, information analysis, and promotions management etc. We work with our service providers to respect and protect your information.

 

 5.      Security, health, administrative, crime prevention/detection and legal purposes

 We may use your personal information to verify your information and identity, and to protect against, identify and prevent fraud and other unlawful activities. We may also share your personal information with government authorities or enforcement bodies for compliance with legal requirements, or as otherwise required or permitted by applicable Data Privacy Law.

 

6.      Other purposes

 We may also use your personal information in other ways, and where we do so, we will provide specific notice at the time of collection and obtain your consent unless otherwise permitted by applicable Data Privacy Law.

 We will only process your personal information where we have a legal basis to do so, which will depend on the reasons for which we have collected and need to use your personal information. In most cases we will need to process your personal information so that we can enter into contracts with you under our Terms of Use (when orders for products are made), and to fulfil the provision or delivery of goods or services to you on the Platform (including subscriptions to the Platform).

 Our processing of your personal information for the above purposes is done pursuant to the following legal basis:

 -         to comply with a legal obligation;

-         the processing is necessary for the performance of a contract with you, such as providing you with our services on the Platform;

-         if it is in our legitimate interests to do so as a business (e.g. for administrative purposes or to improve the functionality of our Platform);

-         where you have consented to our using your personal information (e.g. for the collection of data pertaining to your health status or marketing related uses);

-         where you have made such information public; and

-         to protect your vital interests or those of another person (e.g. in case of a medical emergency).

 Where we receive your personal information as part of providing our services to you based on a contract, we require such personal information to be able to carry out the contract. Without that necessary personal information, we will not be able to provide our services to you. 

 

 Keeping Your Personal Information Secure

 1.      Encryption and Security

Whilst 247 Football is committed to information security, no data transmission over the internet can be guaranteed to be 100% secure.

 We will use all reasonable endeavours (including encryption and authentication tools) to keep the personal information we collect and use in a secure environment, and we have implemented appropriate technical, administrative and physical security measures that are designed to protect personal information from unauthorised access, disclosure, use and modification. 

 The data you provide to us is protected using SSL (Secure Socket Layer) technology, which is the industry standard method of encrypting Personal Data and credit card details so that they can be securely transferred over the internet.

 We use Amazon Web Services (AWS) for data hosting and storage. Further information regarding AWS privacy and security practices, including the latest updates and compliance information, can be found at aws.amazon.com/compliance/data-privacy-faq/ and aws.amazon.com/security/

 

2.      International transfers of your Personal Data

Users personal information is uploaded to and stored on servers that are maintained by third party provider, AWS, at locations in the United States, Europe and Australia. As we operate globally, your personal information may be accessed in countries other than your own location, including outside of the United States, Europe and Australia.  

 

3.      Retention of Your Personal Information

We retain your personal information for as long it is necessary to fulfil the purposes for which it is being processed. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal information, the purposes for which it was obtained, whether we can achieve those purposes through other means, and whether it is required to meet our legal obligations, deal with complaints or queries and enforce our agreements, or to protect our legal rights in the event of a claim being made.

We may otherwise retain and use anonymous and aggregated information for performance reporting, benchmarking and analytic purposes and for product and service improvement.

 When we no longer need your personal data, we will securely delete or destroy it. We will also consider if and how we can minimise over time the personal data that we use, and if we can fully anonymise your personal data so that it can no longer be associated with you or identify you, in which case we may use that information without further notice to you.

 Information that you have shared in the 247 Football Forum will remain public even after you have closed your account. Where you choose to delete content that you have posted to the Forum, the information will not be deleted from third party websites, apps or internet search engine indexes instantly as removal of the content depends on third party policies.

  

Who We Share Your Personal Information With

 We may disclose your personal information to the following categories of recipients:

 1.      Service Providers

a.      our third party service providers who provide IT, analytics, payment processing, credit bureaus and sales, cloud storage providers, technical support or delivery services;

b.      other companies, contractors, agents or consultants in connection with our advertising and marketing efforts, marketing platform providers, research partners or who are otherwise disclosed to you when we collect your personal information;

c.       other companies, contractors or agents that assist us in providing services to you, including our online e-commerce platform that allows us to sell and deliver our products and services to you (which may include Shopify), legal services, debt collection, administration services, customer services and information technology support;

d.      e-commerce providers like Shopify who may offer 247 Football products on our behalf. If you purchase our products offered from these providers, you may be a customer of both 247 Football and the provider, and the provider may collect and share information about you in accordance with their Privacy Policy. Where the information is collected for the purposes of the third party’s own use, we are not responsible for the third parties’ use of your personal information. Please refer to the privacy policy of providers to find out more about these practices;

e.      other companies in connection with providing personalised recommendations to you in your use of the Platform;

 

2.      For Legal Purposes

a.      government authorities, courts, regulators, law enforcement bodies and regulators for compliance with legal requirements, our insurers, our legal and other professional advisers or other third parties where we believe disclosure is necessary:

b.      to comply with applicable law;

c.       to exercise, establish or defend our legal rights including to enforce our legal rights in relation to our contract with you;

d.      to protect your rights or vital interests or those of any other person; or

e.      to detect, prevent or otherwise address security, fraud or technical issues.

 

3.      Other Users of the Platform

a.      depending on your profile settings and how you interact with the Platform e.g. scheduling your Sessions, creating or competing on Leaderboards, sharing your training activities with friends through social media platforms;

b.      if you joined 247 Football via a referral link sent to you by one of your contacts (like a friend, family member, or colleague), we may let that contact know you’ve created a 247 Football account, and provide them a referral bonus as a result;

c.       if you share an invitation to join ‘My Leaderboard’ with a member or non-member of the Platform

 

4.      Third Party Social Media Platforms

a.      if you choose to connect your 247 Football account with third party applications such as Facebook and other social media platforms, we may share certain personal information with the paired application depending on what information you choose to share with such third party apps or have otherwise been disclosed to you during the pairing of the app. Where the information is collected for the purposes of the third party’s own use, we are not responsible for the third parties’ use of your personal information. The processing of your personal information by such third party platforms shall be governed by the Privacy Policies of those parties;

 

5.      Viewers of the Forum

a.      where you choose to post information in the Forum, the information that you share will be public information which can be viewed by anyone (whether or not they are a part of our community). Information posted in the Forum will be indexed to third party internet search engines (such as Google), websites and apps. For further information about how information posted in the Forum is used, please refer to our Forum Community Guidelines;

 

 6.      Potential Buyers (and their agents and advisors)

a.      actual or potential buyers in the event that we sell or transfer all of a part of our company or assets (including in the event of a reorganisation or dissolution / liquidation), under non-disclosure obligations and solely in order to allow a buyer to determine whether to proceed with the transaction, or where such a determination is made, to complete it.

 

 Your Rights and Preferences

 We respect your ability to exercise your privacy rights and preferences under the relevant Data Privacy Laws. Specifically, you have the right and the choice to:

 1.      determine which Third Party Login credentials you supply to us;

2.      opt out of receiving marketing communications or push notifications from us;

3.      request that your personal information be accessed, corrected or deleted by submitting a request to us at support@247footballapp.com

4.      withdraw your consent to us collecting and storing your personal information. This may result in you not being able to use the Platform however.

 

 Cookies, Analytics and Other Tracking Technologies

 When you visit any website, it may store or retrieve information on your browser, mostly in the form of cookies. A cookie is a small recoverable data file that is stored on your web browser. In using the Platform, we, and our third party partners or providers, may use cookies and other tracking technologies to help provide additional functionality of our services and help us to analyse the use of the Platform. This information may be about you, your preferences or your device and is mostly used to make the Platform work as you expect it to, or to provide a more personalised experience on the Platform. We use cookies for several reasons, including:

 1.      for technical reasons in order for our Platform to operate;

2.      to store user preferences and other information to save you time, or tell the web server that you have returned to a specific page;

3.      to enable functionality and personalisation to provide an improved user experience;

4.      to track and target the interests of our users, to help us understand how the Platform is being used or how effective our marketing campaigns are, or to help us customise the Platform for you to deliver customized content and promotions to customers or users whose behaviour indicates that they are interested in a particular subject area;

5.      third party cookies through the Platform for advertising, analytics and other purposes.

 You may manage how you accept or block cookies in the browser settings of your device.

 Our Platform may provide links to other websites for your convenience and information that are not controlled, operated or endorsed by 247 Football. If you visit any website linked to our Platform, you are subject to that website’s own privacy policies, which we strongly suggest you review. To the extent any linked websites are not owned or controlled by us, we are not responsible for their content, any use of the websites, or the privacy practices of the websites.

Children’s Privacy Policy

 247 Football is committed to motivating and inspiring the future generations of football superstars by motivating, engaging and exciting players to train using the 247 Football app. We are committed to protecting your privacy and handling any personal information we obtain from you with care and respect. This Children’s Privacy Policy is written in conjunction with the Privacy Policy as a whole and is provided to assist your understanding of our privacy policies and principles with respect to individuals under the age of majority in your country of residence, including about how we collect, use and disclose personal information from children, and how we obtain consent from the parent or guardian in order for children to use the Platform.

 Users must meet the age of majority in your country of residence, or have the consent of a parent or guardian to use the Platform. The parent or guardian registering on behalf of their child(ren), must give their consent at the time of registration to provide us with information about them and their chid(ren) to use the Platform. We are unable to provide access to the Platform to children under 16 years of age or who are legally a minor in their relevant location, without the parent or guardian providing consent and details to administer the account subscription.

 

What Types of Personal Information Do we Collect?

 We collect personal information when a User registers on the Platform, which is required for full use of the Platform. We may collect the following personal information from children when they use the Platform: first and last name, screen name, parent’s email address, child’s birth date, gender, location, team or club, password, favourite kicking foot, photographic images, video footage, internet protocol address, and other persistent identifiers derived from cookies and smart cookies.

 After registration whereby the parent or guardian’s consent is required, parents and guardians should be aware that a child may provide and share additional personal information whilst using the Platform including but not limited to posting photos and videos of themselves on the Platform.

 

What Information Do We Publish About A Registered Child?

To motivate, engage and excite players to train, we may publish a child’s screen name, first name, social media handles, team, club, age, photos, video footage, training details, Leaderboard positions, location etc in various areas of the Platform or on social media pages etc.

 We do not publish a child’s last name.

 We may also disclose information about a child to our third party partners or providers to assist with the conduct of our business or to enable them to provide services to us. The types of services include but are not limited to shipping, e-commerce, data management, customer service, IT support, email distribution, market research, information analysis, marketing, advice and promotions. We provide our third party partners and service providers with the information they need to perform their services and work with them to respect and protect information.

 

How do We Notify and Obtain Consent From Parents or Guardians for the Collection of Information From Their Children?

 When a child attempts to register on the Platform, we collect the parents email address and send an email to the email address provided. The verifying email contains a link to the Privacy Policy and information on what information we collect and how the parent or guardian can provide consent for the child to use the Platform. If the parent or guardian does not provide consent within 72 hours, we delete the limited information we have collected to that point.

 Once a parent or guardian provides consent, the child is given access to a limited version of the Platform. Upon a subscription being taken, the child will have full access to the Platform, including features that are based on the child’s location and age, and the ability to share personal information within and outside of the Platform.

 

How Can Parents Access, Change, or Delete Personally Identifiable Information About Their Children?

 A parent or guardian can withdraw their consent for us to collect personal information about their child at any time, or request that we delete any personally identifiable information we have collected from our records. To access, change or delete their child’s personal information, a parent or guardian can do so by logging in to the profile section of the child’s account or contacting us directly at support@247footballapp.com

 

How Will We Notify Parents if Our Children’s Privacy Policy Changes?

 We may revise and update this Children’s Privacy Policy at our sole discretion by posting an updated Privacy Policy on the Platform. All such changes to the Privacy Policy are effective immediately when posted to the Platform and apply to all access to and use of the Platform thereafter. We encourage you to refer to our privacy policy regularly so that you stay updated with our current privacy policy. We may also notify the parent’s or guardian’s email about any material changes to the Privacy Policy. Please ensure that your email remains current on your profile.

 

 Updates to this Privacy Policy

 We may revise and update this Privacy Policy at any time at our sole discretion by posting an updated Privacy Policy on the Platform. All such changes to the Privacy Policy are effective immediately when posted to the Platform and apply to all access to and use of the Platform thereafter.

 Your Rights Under GDPR

 We welcome the General Data Protection Regulation (GDPR) of the European Union (EU) as an important step forward in streamlining data protection globally. We intend to comply with the data handling regime laid out in the GDPR in respect of any personal information of data subjects in the EU that we may obtain. The requirements of the GDPR are broadly similar to those set out in the Privacy Act and include the following rights:

 1.      you are entitled to request details of the information that we hold about you and how we process it. For EU residents, we will provide this information for no fee;

2.      you may also have a right to:

a.      have that information rectified or deleted;

b.      restrict our processing of that information;

c.       stop unauthorised transfers of your personal information to a third party;

d.      in some circumstances, have that information transferred to another organisation; and

Processing of Your Data

 Data that we collect about you may be stored or otherwise processed by third party services with data centres based outside the EU, such as Google Analytics, Microsoft Azure, Amazon Web Services, Apple, etc and online relationship management tools. We consider that the collection and such processing of this information is necessary to pursue our legitimate interests in a way that might reasonably be expected (e.g. to analyse how our customers/clients use our services to develop our services and grow our business) and which does not materially impact your rights, freedom or interests. We will require that all third parties that act as “data processors” for us provide sufficient guarantees and implement appropriate technical and organisational measures to secure your data, only process personal data for specified purposes and have committed themselves to confidentiality.

 

Duration of Retention of Your Data

 We will only keep your data for as long as is necessary for the purposes for which it was collected, subject to satisfying any legal, accounting or reporting requirements. At the end of any retention period, your data will either be deleted completely or anonymised (for example, by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning). In some circumstances, you can ask for us to delete your data.
